Kupualor sues all Ada Chiefs for contempt

 

Tema (Greater Accra) 21 September 2001 - A Tema High Court presided over by Mrs Justice Felicity Amoah would on Tuesday September 25, decide the fate of the 23-member Ada Traditional Council for celebrating this year's Asafotufiami festival against the orders of the court.

 

The Court on July 30, this year granted an interim injunction restraining the Council from celebrating the annual festival following a writ filed against it by Nene Tetteh Kupualor Bessey I, a sub-chief of Big Ada.

 

The Council had written to Nene Kupualor Bessey, who is also the President of Civil Engineers and Building Contractors Association of Ghana (CEBAG), telling him not to participate in the festival until a dispute within his Wetsoyi clan over his leadership was settled.

 

Arguing for why the court order was disobeyed, Mr E. K. N. Olaga, leading counsel for the council said the court's order was served on the Registrar of the Council at 17:30 hours just a day before the festival and stopping it would have caused confusion in the whole Ada Traditional area.

 

Mr Olaga said Nene Kupualor misled the court by deliberately hiding pertinent facts about the controversy and by so doing sought to hold the entire Ada State to ransom.

 

He said, even though, the order had been given, it was made in bad faith and, therefore, had no leg to stand on called on the court to revoke its own order since it affected 10 divisions of Ada.

 

Mr Ebo Quarshie, Counsel for the plaintiff, called on the court to reject the defence application and imprison them because they did not show any respect for the court.

 

He said it was also wrong for the defendants to say that their apology was to the judge as a person and not the High Court, which meant they have no regret for their action.
