Court restrains two traditional rulers

Kumasi (Ashanti Region) 17 September 2001 - A High Court in Kumasi has restrained both the plaintiff, Nana Obeng Darko-Kokrodo II and co-defendants, Oheneba Osei Kwame and Samuel Kwabi, all in Kumasi from carrying out any development on the lands in and around Mpatasie near Kumasi pending the determination of a land case before it.

The court, in its order, said both parties, their servants, agents, assigns, workmen be restrained from any manner interfering with the land, the subject matter in dispute, more particularly from granting or carrying out or continuing with any development on the land pending the hearing and determination of this cause or matter before the court.

Presided over by Justice F. Kusi Appiah, the court however, indicated that the Asantehene, Otumfuo Osei Tutu II, is at liberty to apply formally to the court for the settlement of the case out of court.

In a motion of notice by Mr. K.A. Asante-Krobea, counsel for the plaintiff, Nana Darko-Kokrodo asked the court for an interim injunction against the defendants and their agents from carrying out any development of the land at Mpatasie in Kumasi.

Nana Darko-Kokrodo in an accompanying affidavit in support of his statement of claim sought reliefs that he is the Odikro of Mpatasie and caretaker of Mpatasie stool lands while Oheneba Osei Kwame is the Atipimhene of Kumasi.

He said the defendants were served with copies of the writ of summons but they have not heeded the warning to desist from putting up unauthorised structures on the said public plots at Mpatasie.

He said from the time the defendants were served with the writ of summons, they and their agents have intensified their unlawful activities on the stool lands.

Nana Darko-Kokrodo pointed out that in spite of several warnings also from the Kumasi Metropolitan Authority (KMA) city engineer, the defendants and their agents continued with impunity their acts of lawlessness and this compelled the plaintiff to petition the Ashanti Regional Minister.

He indicated that the Mpatasie lands reserved for public development cannot be resold to private developers hence the purported sale and development of the said public lands is unlawful.

He stressed that even though the defendants have been served with all processes from the registry of the court, they are still persisting in their illegal activity by carrying out constructional work on the land.
