Court restrains Nana Issa Yeboah from using "Akokora Bebo Bool"

Kumasi (Ashanti Region) 1st Sept. ’99

A Kumasi High Court presided over by Mr Justice A. K. Abada has ordered Nana Issah Yeboah of Kumasi, from carrying out or doing business under the name "Akokora Bebo Bool" until the final determination of a suit filed by one Mr Smailah Karim.

The order followed an interim injunction filed by Mr Karim, a Koforidua herbalist, seeking the court's authority to restrain Nana Yeboah from using the name "Akokora Bebo Bool" in marketing his medicine.

Meanwhile, the Acting Registrar General has by a letter dated April 10, this year, and signed by Mr A. K. Ohene-Obeng, Principal State Attorney for the Acting Registrar General, ordered Nana Yeboah to change the name of his business.

The letter said it had now been established that "Akokora Bebo Bool" has inadvertently been registered twice.

The first was by Mr Karim in April 1998 under the Registration of Business Names Act of 1962.

It said the Registrar General's Department inadvertently registered another "Akokora Bebo Bool" under the same Business Names Act for Nana Yeboah in January 1999.

Exercising the powers under the Business Names Act of 1962, the Registrar General has, therefore, ordered Nana Yeboah not to trade under Mr Karim's registered name of "Akokora Bebo Bool and to register a new name within six weeks in accordance with Section 215 (2) of the Companies Code.
