Plaintiff files discontinuance notice of writ against Demonstration

Accra (Greater Accra) 25 Nov. ’99

Mr Matthias Anwaatie, a member of the New Patriotic Party (NPP), who filed a writ at an Accra High Court seeking an injunction against opposition parties’ demonstration on Thursday, November 25, has filed a notice of discontinuance of the action.

His Solicitors, Kwaku Baah and Company, filed the notice on Tuesday, November 23, on his behalf.

The plaintiff stated in the notice that he was discontinuing the action "with liberty".

Mr Anwaatie filed the writ on November 18, seeking the court's order to restrain the opposition parties from staging the demonstration.

The writ mentioned Mr S. Odoi-Sykes, NPP, Mr Felix Amoah, Convention Party, Mr Peter Gameli Kpordugbe, National Reformed Party, and Dr. Edward Mahama, Peoples National Convention, as the defendants.

United Ghana Movement was not mentioned in the writ.

The plaintiff claimed in his action that the real objective of the defendants in organising the demonstration was to "cause civil strife and insurrection".

He averred that the defendants have stated elsewhere their determination to make Ghana "ungovernable", which statement amounts to a "disruption of constitutional order".

The plaintiff said the National Democratic Congress was voted to power and has mandate to rule till the end of 2000 when the populace will go to the polls again.

"The acts, pronouncements and threats of the defendants constitute a danger to the security and peace of others, including the plaintiff."
