A
27-year-old driver from Kwahu-Nkwatia, in the Eastern Region who took advantage
of a black out to rape a 14-year old girl was on Wednesday sentenced to seven
years imprisonment in hard labour by an Accra Circuit Tribunal.
The
tribunal, chaired by Mr Charles Quist, also fined Yaw Opare, 1,000,000 cedis on a second count of
threatening to kill with a gun.
He will
serve an additional year in jail if he fails to pay the fine.
The court
heard that due to power cuts in 1998, the girl was sleeping in the open in
their compound house at Darkuman.
DSP Allandu
said at dawn on 14 March 1998, the girl, who stayed in the same house with the
accused, realised that someone was having sex with her and shouted for help.
The
prosecution said her mother upon examining her found her bleeding and reported
the matter to the landlord.
At a
meeting convened by the landlord, Opare admitted having committed the offence
and pleaded that the matter be settled at home.
The
prosecution said when later Opare threatened to kill any member of the house
who discussed the matter. As a result, the girl's mother made a report to the
police and he was arrested.
Two live
cartridges were found in Opare's pocket when he was arrested, the prosecution
told the tribunal.

An Accra
Circuit Tribunal on Wednesday remanded in custody Justice Lamptey, a trader,
who allegedly shot another trader, Mr Abraham Nartey, on suspicion of having an
affair with his wife.
Lamptey,
28, pleaded not guilty to the charge of attempted murder, and will reappear on
15 May.
The
tribunal, chaired by Mrs Elizabeth Anderson Yebuah, ordered that the docket be
sent to the Attorney General's Office for advice.
Police
Inspector James K. Adu told the tribunal that Mr Nartey is a drinking bar
operator and lives at Amanfro in Accra with the accused.
On 20
September 1999, Lamptey's wife sent some eggs to Nartey to be kept in his
fridge, incurring the displeasure of her husband.
Lamptey,
who had suspected Nartey of having an affair with his wife, assaulted the
complainant in his drinking bar.
The
prosecutor said Nartey reported the incident to his uncle, who accompanied him
to demand an explanation from Lamptey.
The accused
slapped the complainant and a scuffle ensued between them during which Lamptey
shot Nartey in the abdomen.
Mr Nartey
was taken to the Korle-Bu Teaching Hospital where he was admitted.
Inspector
Adu said Lamptey absconded but was arrested at his hideout.
