Water Company official acquitted of threat charge

 

Accra (Greater Accra) 14 December 2001 - David Mawuli Fugah, an official of the Ghana Water Company who was charged for threatening a former Managing Director of the company with death, was on Thursday acquitted and discharged by an Accra Circuit Tribunal.

 

Fugah was alleged to have threatened to kill Mr Charles Agyei when he (Fugah) appeared before a Committee of Enquiry that investigated the company. He pleaded not guilty to threat of death

 

Acquitting him, the tribunal, chaired by Mr Ziblim Imoru said although the accused admitted he made the threat he had no intention of carrying it out. "Accused had no intention to put Mr Agyei into fear of death. He made the threat out of frustration and had no means to carry out his threat."

 

The tribunal said Fugah had no weapon and did not buy a gun despite an attack by armed robbers in his home.

 

The prosecution said in May the government set up a committee to investigate Ghana Water Company under the chairmanship of Mr Justice N.Y.B. Adade, a retired Supreme Court Judge.

 

When Fugah appeared before the committee he threatened to kill Mr Agyei. "If I had a gun I would have shot you," he was quoted as having said.

 

The chairman of committee drew his attention to the implication of the threat but Fugah ignored it and repeated the threat. Mr Adjei reported Fugah to the police.
