Ex-Chief sentenced to 14 days imprisonment

Kumasi  (Ashanti Region) 19 December 2000

 

Nana Nkansah Boamah III, former Abadiakyirehene of Dompoase, in the Adansi West district has been sentenced to 14 days imprisonment by a Kumasi High court for disobeying the orders of the Supreme Court.

The court, presided over by Mr Justice Gilbert Quaye said since Nana Boamah "has shown a disposition of non-compliance with the orders of the court, it is left with no choice than to impose a sentence on him".

The court has also ordered him to purge his contempt within 21 days. The court in August this year, in a bide to enforce the Supreme Court ruling, ordered Nana Boamah to surrender within 21 days the black stool and all other paraphernalia in his possession to the elders of his family, which he failed to do.

The Supreme Court in its ruling, struck off an appeal filed by Nana Boamah over his destoolment and awarded two million cedis cost against him.

Nana Boamah was destooled in 1996 by members of his family led by Opanin Kwadwo Poku, Opanin Osei Bonsu and Opanin Kwame Adiyaa

He is said to have misappropriated proceeds from the sale of land, which he did without the consent of his family and his overlord, Dompoasehene Okofo Tabiri Agyei 111.

He was also accused of performing customary rites in respect of the royal mausoleum without the knowledge of his elders and his overlord.

In addition, Nana Boamah was said to have misappropriated 400,000 cedis meant for performing customary rites.

Nana Boamah reacted to the destoolment by filling petitions at the Adansi Traditional Council, the Ashanti Regional House of Chiefs, the National House of Chiefs and the Supreme Court but lost all the bids to win back his title.

Director charged with issuing dud cheque

Accra (Greater Accra) 19 December 2000

 

Walter Deku, director of a company, who is accused of issuing a dud cheque for 2.6 million cedis, for payment to be drawn on the Social Security Bank (SSB), on Monday appeared before a circuit tribunal in Accra.

Deku pleaded not guilty to issuing a dud cheque and was granted five million cedis bail with a surety. The case is rescheduled for January 23, 2001.

The tribunal chaired by Mrs Elizabeth Anderson Yebuah, heard that the accused is a company director, who was standing trial at a circuit tribunal in Accra on charges of defrauding by false pretences involving 800 dollars.

On October 18, in the course of the trial, Deku issued a post-dated cheque for 2.6 million cedis to one Ms Millicent Owusu as payment to be cashed at the Ring Road Central branch of the SSB.

The prosecution said on November 6 when Ms Owusu presented the cheque, it was dishonoured on the grounds that the director did not have any money in his account.

Two file suits against DCEs

Sunyani (Brong Ahafo) 19 December 2000

 

Two persons have filed separate suits against two District Chief Executives (DCEs) in the Brong Ahafo Region at the Sunyani High Court seeking a number of reliefs.

Mr James Druyer, a civil servant, who was dismissed by the Dormaa District Assembly, has filed a suit against the assembly and its District Chief Executive, Nana Kwadwo Boateng.

The statement of claim accompanying the suit called on the court to compel the two defendants to fully comply with a ruling by the Commission on Human Rights and Administrative Justice (CHRAJ) that described Mr Druyer's dismissal as unjustified.

Mr Boakye Yiadom, a businessman based at Goaso, has also filed a suit against the Asunafo DCE, Mr Mohammed Doku, for describing him as a fuel racketeer and defaming him in a national daily.

He is asking the court to order Mr Doku to award him general damages for causing his unlawful arrest and detention.

"The plaintiff wishes to appeal to the honourable court to order the defendant to pay general damages for defamation of character, for causing to be published in 'the Ghanaian Times' of November 14, 2000, that the plaintiff was a fuel racketeer."

Nana Obiri Boahen, a Sunyani-based lawyer filed both suits on behalf of the plaintiffs.

According to the statement of claim by Mr Druyer, though the Sunyani office of the CHRAJ has asked Nana Boateng to re-instate him with the payment of all his salaries in arrears, among others, the DCE has failed to comply with the order.

Mr. Druyer was dismissed by the assembly on November 29, last year, for his failure to report for duty as the postal agent for Dormaa Akwamu. But CHRAJ, after going into the case, found the dismissal unjustified.

This was because Mr Druyer's inability to work was due to the fact that his office was and is still undergoing intensive repairs. This has made it impossible for him to operate.

Mr B. Cab-Yeyuo, Chief State Attorney, has entered an appearance for Nana Boateng.

No dates have been fixed for both cases.

Two remanded for possessing cocaine

Accra (Greater Accra) 19 December 2000

 

An Accra Circuit Tribunal on Monday remanded in custody two people accused of possessing 96 wrappers of cocaine.

Felicia Amartey, 27, unemployed, and Billal Adjei, 40, driver, both of Teshie in Accra, pleaded not guilty to possessing a narcotic drug. They will reappear on January 12, 2001.

The tribunal chaired by Mrs Elizabeth Anderson Yebuah heard that on December 15, this year, one Sergeant Noah Boateng, accompanied by four other policemen, escorted a suspect, Samuel Mensah, to look for an accomplice at Teshie, who was alleged to be involved in a stealing case at the Nungua Police Station.

When they got to the house, Mensah identified Adjei as the accomplice.

The prosecution said Amartey, who was sleeping on the porch of the building, then hid a blue polythene bag which she was holding under a table but the police were quick to apprehend her.

The police found 96 wrappers of a whitish substance suspected to be cocaine concealed in a purse in the polythene bag.

The prosecutor said when interrogated, Amartey mentioned Adjei as the owner of the bag, adding that Adjei admitted having given the bag to Amartey.
