Court rules on Atebubu chieftaincy matter

Sunyani (Western Region) 28 Dec. '99

The Court of Appeal (Civil Division) has dismissed an action brought before it by Odeneho Owusu Sekyere, asking the court to set aside a Sunyani High Court ruling, which convicted him of contempt for holding himself as the substantive Omanhene of Atebubu in the Brong Ahafo Region.

The court, sitting in Accra and presided by Mrs Justice G.T. Wood, on 16 December this year, found no merit in the appeal and accordingly dismissed it.

It awarded a cost of three million cedis against Odeneho Owusu Sekyere.

In January this year, the Sunyani High Court, presided over by Mr Justice Paul K. Gyaesayor, ruled that by acting as chief, Odeneho Owusu Sekyere had violated an order by the Brong Ahafo Regional House of Chiefs restraining him from holding himself as such.

The Judicial Committee of the House had earlier upheld a petition brought before it by Nana Asibaa Kyere Mmorosa, Akyeamehene and Nana Yaw Yeboah, Akwamuhene of the Atebubu Traditional Area, that Odeneho Owusu Sekyere was not properly enstooled and therefore could not act as Atebubu Omanhene.

Although the House's judgement went in favour of the petitioners, Odeneho Owusu Sekyere continued to hold himself as Omanhene of Atebubu.

The House brought the matter before the Sunyani High Court for adjudication "since the conduct of Odeneho Owusu Sekyere was contemptuous of the ruling of the House of Chiefs."

Odeneho Owusu Sekyere brought the matter before the Court of Appeal seeking to quash the judgement of the High Court.

Mr Justice S.A. Brobbey and Mr Justice D.K. Afreh were the other members of the panel.
