Court orders KMA to hand over stores to Kejetia traders

A Kumasi High Court presided over by Mr Justice Gilbert Mensah Quaye, has ordered the Kumasi Metropolitan Assembly (KMA) to allocate storerooms at the North Suntreso market complex to members of the Kejetia Traders Association, who contributed money towards its construction.

It directed the KMA not to allocate the stores to non-members of the association so that those, who contributed would have priority in the allocation.

Mr Justice Quaye was giving a ruling in a case, in which the association also known as Mighty 18 filed a suit against the KMA to seek some relief.

The association said there was an oral contract between them and the KMA to the construct the stores and was therefore seeking a perpetual injunction to restrain the KMA from distributing the stores to any other people apart from members of the association.

The association also sought for a relief to recover about 44 million cedis from the KMA being the amount it claimed to have spent on the project.

The Presiding Judge said those who paid less than the full amount ought to be given time within, which to complete the payment or they would then lose their chance and have their deposit refunded to them.

The Court, however, said there was no case against Mr Kofi Nsiah of Nsiah Contractors assigned to undertake the construction by the association.
