An attempt by the Acting Chairman of the Convention Party (CP), Mr Felix Amoah to have a case in which he and two others have been restrained from holding the party's congress settled out of court failed on Monday.

This was after the High Court, which slapped them with the injunction ordered that the matter should proceed after the two parties had failed to agree on the terms for settlement.

The court is hearing an application filed by the CP, its Chairman and the General Secretary asking it to set aside the order.

The court, after consulting counsel for both sides, stood the case down to enable them to consult.

On resumption, both sides agreed in principle to have the matter settled but counsel for the plaintiffs, Captain Nkrabeah Effah-Darteh (rtd) said he would like the matter settled first before the injunction is set aside while the defendants wanted it the other way round.

The court at this juncture ordered that Capt., Effah-Darteh should continue with his submissions, which he started last Thursday.

He urged the court not to set aside the injunction granted them on 18 November, as requested by the defendants, who claimed, that the "plaintiffs suppressed material facts" from the court which made it to restrain them.

Counsel submitted that one of the grounds of the plaintiffs was that, the defendants violated some provisions in the party's constitution, which spells out the processes by which presidential candidates are vetted before they subject themselves for election.

He said, the constitution says that no member of the Central Committee of the CP must be a member of the vetting committee.

However, Capt. Effah-Darteh said, the defendants in a document attached to their affidavit in support of their application stated that four members of the central committee including its general secretary were members of the vetting committee.

Counsel again said it is a fact that not all the founding members were notified about the holding of the congress as the party's constitution demands.

Hearing continues on Wednesday, 8 December.
