Man accused of defiling step-daughter, claims impotency

Sekondi (Western Region) 03 August 2000

There was drama at the Sekondi Circuit Tribunal on Wednesday when Kwesi Tawiah, a 45-year-old grader operator, who appeared before it for defiling his 14-year old stepdaughter said he was impotent.

Opening his defence the accused persistently told the tribunal chaired by Mr. Frederick Miezah-Anyimiah that he is impotent and could not be charged for the offence.

He said that he had consulted herbalists and spiritualists for assistance but to no avail. This caused laughter in the courtroom. He pleaded guilty and the case was adjourned to August 10.

When the Judge recommended that the accused should be sent to the hospital to ascertain the validity of his claim he refused saying that his problem was spiritual and had been caused by his first child.

Police Inspector Prosper Yao Aheto, said that the accused has been married to Ama Esson, who is the mother of the victim, for three years.

Three months ago, Esson detected that Tawiah has been having sex with his stepdaughter and warned him to stop, but he continued.

This infuriated Esson, who left the matrimonial home for Shama, her hometown with the victim.

The accused went for the girl and has since been living with her as husband and wife.

He said the Police arrested Tawiah and the girl when Esson reported the matter to them.

Court sentences complainant, frees accused

Asamankese (Greater Accra) 03 August 2000

An electronics technician, Sammy Boateng, who reported a case of offensive conduct against a client to the police, was eventually charged with the same offence and sentenced by an Asamankese Circuit Court.

The prosecution had told the court that on June 5 at Asuom, Isaac Asare, a tailor, who had given his cassette-recorder to Boateng for repairs, insulted Boateng because he had taken too long in repairing the machine.

Asare, who had pleaded guilty with explanation in his evidence, said Boateng received 15,000 cedis to buy a spare part to repair the recorder but did nothing on the machine for a whole month.

He, therefore, went to demand the amount and the machine but Boateng got angry, resulting in an exchange of words that could have led to a breach of the peace.

The presiding judge, Mr. S.S. Appiah, however, ordered that the complainant (Boateng) be charged with offensive conduct and be put before the dock, saying that it was unreasonable for any competent technician to keep an appliance for a month without repairing it.

He said if Boateng had refunded the money and given Asare back his machine, there would not have been any trouble.

Mr. Appiah noted that Boateng was one of those technicians and craftsmen who take delight in keeping people's appliances in their workshops.

He therefore acquitted and discharged Asare but sentenced Boateng to a fine of 100,000 cedis or in default to go to prison for 14 days.

Additionally, he was ordered to refund the 15,000 cedis given him by Asare to buy the parts and pay 10,000 cedis to him to cover his costs or serve a further 14 days in jail.
